By downloading, installing, or using the WildNutri Pro application, website, or any associated content, calculators, species profiles, downloadable materials, or community features, you confirm that you have read, understood, and agree to be bound by these Terms of Use in their entirety. If you do not agree, you must not use WildNutri Pro.
1. Definitions
“WildNutri Pro Puggle” means the Puggle website, mobile applications, educational husbandry simulation, account services, subscriptions, institutional access, cloud saves and related content provided by or on behalf of the Developer.
“Developer” means the owner and operator of WildNutri Pro, Daniel R. Lack / Dave Enterprises, ABN registered in Australia, operating as WildNutri Pro.
“User” / “You” means any individual or organisation who downloads, installs, accesses, or uses WildNutri Pro in any capacity, including free-tier and paid-tier subscribers.
“Content” means all text, data, species profiles, nutritional calculators, BMR-based outputs, ingredient breakdowns, downloadable documents, community posts, and other material available within WildNutri Pro.
“Veterinarian” means a qualified, licensed, and registered veterinary professional in the relevant jurisdiction with authority to diagnose and treat animal health conditions.
“Nutritional Information” means species-specific dietary guidance, Kleiber BMR-based caloric calculations, ingredient breakdowns, body condition scoring references, and related data provided within WildNutri Pro.
“Subscription” means a paid monthly or annual access arrangement to WildNutri Pro’s premium features, billed in Australian Dollars (AUD) at the current published rate.
2. Nature of the Service — What WildNutri Pro Is and Is Not
2.1 What WildNutri Pro provides
WildNutri Pro is an educational reference tool designed to assist keepers, veterinarians, zookeepers, wildlife workers, conservationists, researchers, students, and engaged pet owners in understanding species-appropriate nutrition. It provides:
- Species-specific nutritional profiles across exotic, wild, domestic, and livestock species
- Kleiber Basal Metabolic Rate (BMR)-based caloric calculators
- Per-gram ingredient breakdown calculators and dietary planning tools
- Body condition scoring reference information
- Downloadable feeding guides and reference materials
- Community discussion features for knowledge sharing
- Educational gamification features including species-based feeding simulations
2.2 What WildNutri Pro is NOT
WildNutri Pro is NOT a veterinary service and does NOT provide veterinary advice, diagnosis, or treatment. It is NOT a substitute for professional veterinary consultation under any circumstances.
Specifically, WildNutri Pro does not:
- Diagnose, treat, cure, or prevent any disease, disorder, or health condition in any animal
- Replace the professional judgement of a licensed and registered veterinarian
- Provide emergency or crisis animal care guidance
- Account for the individual health status, medical history, or clinical presentation of any specific animal
- Guarantee that any nutritional plan, calculator output, or species profile is appropriate for any individual animal without professional veterinary assessment
- Provide advice regarding animals with confirmed or suspected illness, disease, parasitic infection, metabolic disorder, or other systemic health concern without concurrent veterinary supervision
3. Veterinary Consultation — Critical Notice
THE DEVELOPER STRONGLY RECOMMENDS AND URGES ALL USERS TO CONSULT A QUALIFIED, LICENSED VETERINARIAN BEFORE MAKING ANY SIGNIFICANT CHANGE TO AN ANIMAL’S DIET, NUTRITIONAL PLAN, OR FEEDING REGIME, AND IN ALL CASES WHERE AN ANIMAL SHOWS ANY SIGN OF ILL HEALTH, ABNORMAL BEHAVIOUR, OR SUSPECTED NUTRITIONAL DEFICIENCY.
3.1 When veterinary consultation is particularly critical
- Any animal showing signs of illness, lethargy, weight loss, weight gain, or behavioural change
- Animals with confirmed or suspected metabolic disorders, including but not limited to metabolic bone disease, thiamine deficiency, hypocalcaemia, or hepatic lipidosis
- Nutritional planning for pregnant, lactating, juvenile, geriatric, or post-surgical animals
- Species for which nutritional science remains limited or contested in the published literature
- Animals recovering from injury, illness, or nutritional deficiency
- Situations where a change in diet is being made as a therapeutic or corrective intervention
- Any animal in institutional, zoo, sanctuary, or wildlife rehabilitation care where professional nutrition oversight protocols apply
- Circumstances involving novel, unusual, or highly specialised diets not commonly documented
- Any situation in which the User is uncertain or lacks confidence in the nutritional plan
3.2 Calculators and profiles are starting points, not endpoints
The nutritional calculators and species profiles within WildNutri Pro are evidence-informed reference tools based on published zoological, veterinary, and nutritional science literature. They represent general population-level guidance. Individual animals vary significantly in their nutritional requirements based on factors including age, sex, reproductive status, activity level, health status, housing conditions, climate, and individual metabolic variation. No calculator or profile can account for all these variables. A veterinarian or qualified animal nutritionist must always be the final authority on the nutritional management of any individual animal.
WildNutri Pro’s community features, including discussion forums and query posting, are provided for peer knowledge-sharing purposes only. No response from another user within WildNutri Pro constitutes professional veterinary advice, regardless of the professional background of the responding party. The Developer accepts no responsibility for community-generated content.
4. Acceptable Use
4.1 Permitted use
WildNutri Pro is provided for lawful, personal, professional, educational, and research purposes related to animal nutrition and welfare. Users may:
- Access species profiles and calculators for reference and educational purposes
- Download materials for personal or professional use, not for redistribution
- Share information from WildNutri Pro with veterinarians, keepers, or caregivers in the context of animal care
- Participate respectfully in community features
4.2 Prohibited use
- Use WildNutri Pro content as a substitute for veterinary advice or professional animal care
- Reproduce, resell, redistribute, or commercially exploit any WildNutri Pro content without written permission from the Developer
- Reverse engineer, copy, scrape, or attempt to extract the underlying database or IP of WildNutri Pro
- Post harmful, abusive, misleading, or unlawful content in community features
- Use WildNutri Pro to justify withholding necessary veterinary care from any animal
- Misrepresent WildNutri Pro content as constituting professional veterinary advice
- Use WildNutri Pro in any manner that violates applicable animal welfare legislation in the User’s jurisdiction
5. Disclaimer of Warranties and Accuracy
WildNutri Pro content is developed with reference to current published scientific literature, zoological and veterinary best practice, and the Developer’s professional expertise. However, nutritional science is continuously evolving, and species-specific data varies in depth and reliability across taxa. The Developer does not warrant that all nutritional data, calculator outputs, or species profiles are complete, current, accurate, or free from error; that information is appropriate for every individual animal within a given species; that the app is free from technical errors, interruptions, or data loss; or that results obtained through the calculators will achieve any particular nutritional outcome.
WildNutri Pro is provided “as is” and “as available” without warranty of any kind, express or implied, to the fullest extent permitted by applicable law, including the Australian Consumer Law and equivalent international consumer protection frameworks.
Where statutory consumer guarantees apply under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or equivalent international legislation, those guarantees are not excluded. Nothing in these Terms limits any right that cannot lawfully be excluded.
6. Limitation of Liability
To the fullest extent permitted by law, the Developer, its officers, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive loss or damage of any kind arising from or in connection with the use of, or inability to use, WildNutri Pro, including but not limited to:
- The death, injury, illness, or deterioration of any animal resulting from reliance on WildNutri Pro content, whether or not veterinary advice was sought concurrently
- Financial loss arising from decisions made in reliance on WildNutri Pro
- Loss arising from inaccurate, incomplete, or outdated nutritional data
- Loss arising from community-generated content posted by other users
- Data loss, app unavailability, or technical malfunction
- Any loss arising from the User’s failure to seek appropriate veterinary advice
Where the Developer’s liability cannot be excluded by law, liability is limited to the resupply of the service or the cost of having the service supplied again, or a refund of subscription fees paid in the relevant period, at the Developer’s election.
7. User Indemnification
You agree to indemnify, defend, and hold harmless the Developer and its related parties from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of WildNutri Pro in breach of these Terms; your reliance on WildNutri Pro content without appropriate veterinary consultation; any content you post or share within WildNutri Pro community features; your violation of any applicable animal welfare, veterinary, or consumer law; or any third-party claims arising from your use of WildNutri Pro.
8. Intellectual Property, Proprietary Technology and Non-Replication Agreement
8.1 Ownership of proprietary technology
WildNutri Pro represents original, privately developed technology created and owned exclusively by Daniel R. Lack / Dave Enterprises. This technology constitutes a proprietary system of animal nutrition analysis, calculation, and reference that has been independently conceived, designed, and built. All elements of WildNutri Pro are protected under Australian and international intellectual property law, including but not limited to copyright, trademark, trade secret, and applicable patent law.
8.2 Proprietary calculations and systems
The calculation methodologies, algorithmic systems, nutritional frameworks, species-specific data structures, Kleiber BMR implementation logic, ingredient breakdown systems, body condition scoring frameworks, and all associated computational methods within WildNutri Pro are privately developed, proprietary inventions. These systems are original works of authorship and technological innovation. BY ACCESSING WILDNUTRI PRO, YOU ACKNOWLEDGE THESE SYSTEMS AS PROPRIETARY TECHNOLOGY AND AGREE THAT THEY MUST NEVER BE REPLICATED, REVERSE ENGINEERED, REPRODUCED, OR ADAPTED.
Specifically, the following constitute protected proprietary technology of WildNutri Pro and may not be replicated, reproduced, adapted, or used as the basis for any competing or derivative product, service, tool, or system, whether commercial or non-commercial:
- The species-specific nutritional profiling methodology and database architecture
- The Kleiber Basal Metabolic Rate (BMR) calculator implementation and formula application as developed and adapted specifically for WildNutri Pro’s multi-species framework
- The per-gram ingredient breakdown calculator logic and dietary composition analysis system
- The multi-species body condition scoring reference framework
- The species taxonomy and classification system as applied within the WildNutri Pro database
- The gamification and species-progression mechanics including the virtual feeding simulation system
- The tiered species unlock architecture and associated progression framework
- All data structures, schemas, and relational logic underlying the WildNutri Pro species database
- Any combination or synthesis of the above elements as an integrated system
8.3 Patent protection
The Developer has asserted patent rights over the proprietary calculation systems, algorithmic methodologies, and technical architecture of WildNutri Pro. Users are on notice that the Developer actively monitors for and will pursue enforcement action against any replication, reproduction, or adaptation of WildNutri Pro’s proprietary technology, whether by individuals, organisations, commercial entities, academic institutions, or any other party. Patent protection extends to the core inventive concepts underlying WildNutri Pro’s technology, not only its surface expression.
8.4 Permitted purpose — binding agreement
By accessing WildNutri Pro, in whole or in part, whether via a free or paid tier, you enter into a binding agreement with the Developer that your access to and use of WildNutri Pro’s technology, data, calculators, species profiles, and associated systems is permitted solely for the purpose of personal learning, professional reference, and the direct application of nutritional knowledge to the benefit of captive, domestic, livestock, and wild animal welfare. No other use is authorised.
Users are expressly prohibited from using WildNutri Pro to develop, train, inform, or seed any competing product, application, dataset, algorithm, AI model, or nutritional reference system; extracting, scraping, copying, or otherwise harvesting WildNutri Pro data, profiles, or outputs for use outside the app; sharing, distributing, or publishing WildNutri Pro content in a manner that replicates or substitutes for the WildNutri Pro product; using access to map, document, or analyse its proprietary systems for competitive intelligence or product development purposes; or permitting, authorising, or facilitating any third party to do any of the above.
8.5 Trademark and branding
A Class 9 trademark application has been filed with IP Australia for the WildNutri Pro mark. The WildNutri Pro name, logo, and associated branding may not be used, reproduced, or associated with any third-party product, service, or content without express written permission from the Developer. Unauthorised use of the WildNutri Pro trademark will be actively enforced.
8.6 Original images and media
All 1,300+ original images within WildNutri Pro are wholly author-owned and protected by copyright. No images, illustrations, or visual assets may be reproduced, extracted, redistributed, or used without express written permission from the Developer.
9. Subscriptions, Payments, and Cancellations
9.1 Subscription tiers
WildNutri Pro offers a free tier with limited species access and a paid subscription providing access to the full species library, all calculators, downloadable materials, and premium features. Pricing is published within the app and on the WildNutri Pro website and is denominated in Australian Dollars (AUD). International pricing may vary based on applicable taxes and local currency conversion.
9.2 Billing
Paid subscriptions are billed on a recurring monthly or annual basis via the Apple App Store, Google Play Store, or other designated payment processor. By subscribing, you authorise recurring charges at the then-current subscription rate until cancellation.
9.3 Cancellation and refunds
You may cancel your subscription at any time through your device’s app store account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled in accordance with Apple App Store, Google Play Store, or applicable payment processor policies, and applicable consumer law in your jurisdiction, including Australian Consumer Law.
9.4 Price changes
The Developer reserves the right to modify subscription pricing with reasonable prior notice to existing subscribers. Continued use after a price change constitutes acceptance of the new pricing.
10. Privacy and Data Collection
10.1 Data collected
- Account registration information (email address, name, professional role if provided)
- In-app usage data including species searched, calculators used, and features accessed
- Subscription and payment metadata (processed by the relevant app store, not stored by the Developer)
- Community content posted by the User
- Device and technical data for app performance and debugging purposes
10.2 How data is used
- Provide and improve the WildNutri Pro service
- Manage subscriptions and communicate with Users
- Develop new species profiles and features informed by aggregate usage patterns
- Comply with legal obligations
10.3 Data sharing
The Developer does not sell, rent, or share personal data with third parties for marketing purposes. Data may be shared with service providers necessary for app operation (e.g. hosting, analytics) under appropriate data processing agreements. Data may be disclosed where required by law or legal process.
10.4 Your rights
Users may request access to, correction of, or deletion of their personal data by contacting the Developer at the address below. Rights vary by jurisdiction and applicable privacy law, including the Australian Privacy Act 1988 (Cth) and, where applicable, the European General Data Protection Regulation (GDPR) and equivalent frameworks.
11. Community Features, Species Chat Rooms, and Community Conduct
11.1 Purpose and philosophy
WildNutri Pro’s species-specific chat rooms and community features are built on a single foundational principle: we never stop learning. The community exists as a collaborative space for keepers, vets, zookeepers, wildlife workers, nutritionists, researchers, students, and engaged animal owners to share knowledge, exchange ideas, ask questions, and discuss real-world challenges in animal nutrition and care.
This includes difficult conversations. The Developer actively encourages open, honest discussion of challenging situations, past mistakes, unexpected outcomes, and cases where things did not go to plan. Honest reflection on adverse experiences is one of the most powerful tools for collective learning in animal care.
11.2 Permitted community use
- Sharing nutritional approaches, feeding strategies, and dietary observations for specific species
- Asking questions about species-specific nutrition, ingredient suitability, or dietary planning
- Exchanging ideas and inviting peer input on nutritional challenges
- Discussing real-world outcomes, including unexpected results, complications, or cases where a nutritional approach required adjustment
- Seeking general community thoughts prior to veterinary consultation, or sharing outcomes following veterinary review
- Celebrating welfare improvements and positive outcomes in animal nutrition and care
- Sharing professional knowledge, published research references, and evidence-based insights
11.3 Community conduct standards — binding requirements
WildNutri Pro’s community is built on respect, curiosity, and a shared commitment to animal welfare. Abusive, bullying, discriminatory, aggressive, or prejudicial conduct of any kind has no place in this community and will not be tolerated under any circumstances.
By participating in any WildNutri Pro community feature, you agree that you will not post abusive, threatening, harassing, intimidating, discriminatory, aggressive, hostile, deliberately misleading, unlawful, or harmful content; engage in bullying, personal attacks, mocking, or sustained negative behaviour; dismiss, shame, or ridicule another User’s experience or question; promote products or services deceptively or unsolicited; or post content that violates applicable law, including animal welfare legislation.
11.4 Consequences of conduct violations
Consequences may include a formal written warning, temporary suspension, permanent removal of access to community features, or subscription termination for severe breaches, subject to applicable consumer law. Users may appeal a community suspension or subscription termination by contacting the Developer in writing. Appeals will be reviewed within 14 days. Reinstatement is at the Developer’s sole discretion.
11.5 User-generated content licence and responsibility
By posting content in any WildNutri Pro community feature, you grant the Developer a non-exclusive, royalty-free, worldwide licence to display, moderate, archive, and remove your content within the app; confirm that your content does not infringe third-party rights; accept sole responsibility for its accuracy, appropriateness, and lawfulness; and acknowledge that community responses do not constitute formal professional advice and carry no liability for the Developer.
No community response within WildNutri Pro constitutes veterinary advice. Always consult a licensed veterinarian for health-related animal concerns.
12. International Users
WildNutri Pro is available in multiple languages and jurisdictions. These Terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia. International Users access WildNutri Pro on this basis and are responsible for compliance with all applicable local laws, including animal welfare legislation, veterinary practice regulations, and data protection requirements in their jurisdiction. Where consumer protection laws in a User’s jurisdiction provide rights that cannot be excluded or limited, those rights apply in addition to these Terms.
13. Changes to These Terms
The Developer reserves the right to update these Terms at any time. Material changes will be notified via in-app notification or email to registered subscribers with a minimum of 14 days’ notice before taking effect. Continued use of WildNutri Pro after the effective date of updated Terms constitutes acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from or in connection with these Terms or WildNutri Pro shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be referred to mediation in New South Wales before any legal proceedings are commenced, except where urgent injunctive or interlocutory relief is sought to protect intellectual property or confidential information.
